Interest Rate remains unchanged!

The South African Reserve Bank left its repo rate unchanged at 5.5% on Thursday as expected, with concerns about a slowing economy off-setting the pressures from inflation, which is likely to stay outside its target band for longer than previously expected.

Important Changes in the Law

Consumer Protection Act

Those rules and regulations pertaining to consumer rights were in the past regulated in bits and pieces in a variety of laws and are now combined in one single Act, the Consumer Protection Act. The new law has come into force and effect on 31 March 2011 and replaces all previous regulations in the Consumer Affairs Act of 1988 as well as the Trade Practices Act of 1976, the Sales and Service Matters Act of 1964, the Price Control Act of 1964 and the Merchandise Marks Act of 1941.

Company Law

The previous company law consisting of the Companies Act of 1973 and the Close Corporations Act of 1984 has been replaced by a new, single Companies Act, which came into force and effect on 1 May 2011. Previous types of corporate incorporation have been abolished, amongst it the Close Corporation, and replaced by a variety of new company types.

Corporate Governance

The existing, fragmented set of rules and regulations of corporate governance has been completely revamped based on the King III Report and came into force and effect well ahead of the new Companies Act already on 24 October 2010.

Immigration Law

The current immigration law, which in 2002 by means of enacting the Immigration Act replaced the old Aliens Control Act of 1991 is currently being amended to a large extent. Most of the conditions for existing permits as well as available kinds of permits will drastically change. After the public participation process is finalised it is expected that it will come into force and effect during the second quarter of 2012.
