Introduction
South Africa’s immigration system has been undergoing a transformation under the leadership of Minister Schreiber. While there has been notable progress in clearing the substantial visa backlog, this progress has brought new challenges to light, especially in adjudication and the appeals process.
Clearing the Backlog
The visa backlog, which previously stood at 300,000, has been significantly reduced, with reports indicating a 90% decrease. Many applicants have received long-awaited positive outcomes, reflecting the minister’s commitment to efficiency.
However, progress has not been without its flaws. While the backlog reduction is commendable, it appears to have been achieved partly through rapid adjudication processes. Unfortunately, this has resulted in numerous rejections, many of which cite questionable or legally unsound reasons. Applicants who receive these rejections find themselves entangled in an overburdened appeals system, facing significant delays and uncertainty.
Adjudication Concerns and Appeal Delays
The increase in rejections is alarming, as it suggests that the quality of adjudication has been compromised in favour of speed. Applicants with strong cases have reported receiving rejections for reasons that are poorly justified. These decisions undermine confidence in the system and place an unnecessary burden on the appeals process.
Before the backlog clearance efforts, the appeals process already faced delays of up to six months. Now, with a dramatic increase in appeals resulting from questionable rejections, the waiting period is expected to stretch to 10 to 12 months.

For those who have received rejections, you are not alone. Many applicants are in the same position, grappling with unclear or unsound reasons for denial.
If your rejection was wrongful, our advice is to prepare for either resubmitting your application with more comprehensive supporting documents or embarking on the lengthy appeals process.
